Introduction

The Extended Eats program allows food and beverage (F&B) businesses in the Burwood LGA to extend their outdoor dining area along adjacent building frontages, provided permission is obtained from the neighbouring business and property owner. This initiative supports vibrant street life, encourages community interaction, and maximises the use of public space for dining. This policy sets out the conditions, responsibilities, and approval process for participating businesses to ensure safe and harmonious integration with the surrounding streetscape.

Who can apply to participate in the Extended Eats program?

The program is open to food and beverage (F&B) businesses within the Burwood LGA that:

  • Already have an existing outdoor dining approval.

  • Have fully used the outdoor space in front of their premises.

  • Obtain written consent from the neighbouring business and property owner to use their frontage.

The program applies to active retail frontages that are not occupied by another food or beverage business.

 

 

How can businesses apply?

Interested businesses must:

  1. Submit an Expression of Interest application form.

  2. Provide:

    • Proof of existing outdoor dining approval.

    • Written consent from the adjacent business and property owner.

    • A description of proposed enhancements (e.g. seating, umbrellas, greenery).

  3. Await Council assessment based on eligibility, public safety and site conditions.

No additional fees or charges apply to the extended area, though existing outdoor dining fees remain.

 

 

What responsibilities do businesses have?

Participating businesses must:

  • Provide and maintain high-quality outdoor furniture (tables, seating).

  • Keep the area clean, safe, and well-presented at all times.

  • Ensure pedestrian pathways remain clear (minimum 1.8m) and accessible.

  • Address any issues raised by neighbouring businesses and work cooperatively.

  • Hold public liability insurance of $20 million covering the extended dining area.

  • Operate only within approved trading hours and remove or secure furniture after hours.

 

What are the approval conditions?

Neighbouring business consent: Written agreement is required before extending.

Pedestrian and traffic safety: The extension must not block footpaths, ramps, or emergency exits.

Vacant tenancies: Approvals may be amended or revoked if a neighbouring space becomes occupied by another F&B business.

Council discretion: Burwood Council may refuse, modify or revoke approvals if safety or compliance issues arise.

Policy alignment: All extensions must comply with Council’s footpath activation and accessibility standards.

 

 

How does Council monitor and manage the program?

Council will periodically review and inspect approved extended dining areas to ensure they meet policy, safety and amenity standards.

Businesses that fail to comply may have their approval amended or revoked.

Council may adjust the program over time based on community feedback, safety outcomes, and placemaking priorities.
