Development Contributions Voluntary Planning Agreements

Development contributions are payments, or the provision of works by developers, for community facilities and services. In addition to developer contributions, a developer may enter into a Planning Agreement with Council to provide a public benefit.

Development Contributions

Development contributions are payments or the provision of works by developers for community facilities and services such as sports fields, parks, traffic management facilities and community centres. These contributions help provide and improve community amenities and services. 

The Environmental Planning Assessment Act 1979 (EP&A Act) and Environment Planning and Assessment Regulation 2021 sets out how the development contributions system works in NSW. The development contributions are levied under section 7.11, section 7.12 and section 7.13 of the EP&A Act.

Burwood Council levies development contributions in accordance with section 7.12 of the EP&A Act. The levy is applied as a percentage and contributions are used to assist in the provision and delivery of infrastructure across the Local Government Area in line with demand for public services and infrastructure.

Development Contributions Register

Council is required to maintain a Contributions Register, which contains contributions levied and paid as conditions of approved development applications or complying development certificates.

The register contains information from 1 July 2022, and is updated at the end of each month.

Voluntary Planning Agreements Policy

A Planning Agreement (also commonly referred to as a voluntary planning agreement or VPA) is an agreement entered into by a planning authority (such as Burwood Council) and a developer.

A planning agreement can provide for the payment of a monetary contribution, dedication of land, or any other public benefit to be used for a public purpose.

Planning agreements may operate alongside section 7.12 contributions plans or may exempt developer contributions as part of the agreement.

Planning agreements cannot be entered into unless public notice has been given and an explanatory note is made available for inspection for at least 28 days.

Council's Planning Agreements Policy(PDF, 328KB) was adopted by Council on 6 December 2005 and was amended on 30 October 2018.

The Policy provides guidelines for both the Council and developers to effectively negotiate and prepare Planning Agreements, and provides a template planning agreement document.

The Planning Agreements Policy is integral to the implementation of Council’s Policy on Carrying Out Bonus Development in the Public Interest (adopted by Council on 21 August 2018 and effective from 1 September 2018), and the Burwood Development Control Plan (BDCP) parking guidelines in business zones (adopted by Council on 4 December 2012).
