Introduction

Burwood Council is providing businesses with expanded opportunities for trade including the temporary use of on-street car parking spaces for outdoor dining.

Parklets provide additional public space for people to stop rest and socialise and encourages a stronger sense of community through the creation of safe public gathering spaces.

Council is seeking expressions of interest from suitable businesses who wish to trial the use of a Parklet during the period July 2022 to June 2023. 

Objective

  1. Support the economic recovery of Burwood.
  2. Promote an activated and vibrant street culture.
  3. Encourage and facilitate safe high quality outdoor dining that takes into account the needs of the public as well as businesses. Enhance the provisions set out in existing Council policies and support the State and Federal Government’s commitment to encourage the use of public spaces for outdoor dining post-lockdown.
  4. Maintain a high quality public domain that contributes to public amenity.
  5. Facilitate opportunities for expanded outdoor dining that does not impact or obstruct pedestrian traffic.

What is the Parklet Program?

The Parklet Program allows approved hospitality businesses to temporarily extend outdoor dining onto on-street parking spacesThese temporary parklets create additional public space for people to relax, socialise, and enjoy street life supporting local business recovery and a more vibrant public realm.

  • Duration: 3-month trial per business (Council may extend or relocate the parklet).

  • Cost: No fee for use during the trial period.

  • Purpose: Encourage outdoor dining, improve public amenity, and activate the Burwood Town Centre.

 

 

Who can apply?

Eligible businesses must:

  • Be a café or restaurant serving food and drinks for consumption on the premises.

  • Be located within the Burwood Local Government Area.

  • Have suitable kerbside road space adjacent to their business that won’t disrupt traffic or pedestrian safety.

  • Hold public liability insurance with minimum cover of $20 million.

  • Have an existing footpath dining approval and a registered COVID Safety Plan.

Not eligible: bottle shops, tobacco shops, venues with gambling, or businesses in unsuitable road spaces such as bus zones, clearways, or accessible parking.

 

How do businesses apply?

Businesses interested in hosting a parklet must:

  1. Submit an Expression of Interest (EOI) application form.

  2. Provide required documentation, including insurance and site suitability information.

  3. Undergo Council assessment based on safety, location, and operational considerations.

  4. If approved, Council will install and remove the parklet at no cost to the business.

Council will select proposals at its discretion and may prioritise businesses with limited existing outdoor dining space.

 

 

What are businesses responsible for?

Once a parklet is installed by Council, the business is responsible for:

  • Daily cleaning and maintenance, including proper waste disposal (no use of public litter bins).

  • Keeping the parklet in good and safe condition at all times.

  • Watering plants weekly and lowering umbrellas in severe weather.

  • Reporting any damages or safety issues to Council immediately.

  • Ensuring the space remains accessible to the general public (no exclusive use).

  • Providing and maintaining valid public liability insurance.

Failure to maintain the parklet to Council’s standards may result in its removal.

 

 

What are the key conditions of use?

  • Parklets remain public space and cannot be used exclusively by businesses.

  • No alcohol service is permitted within the parklet.

  • Businesses cannot modify or add any structures, signage or fixtures.

  • Council may relocate or remove a parklet at any time due to roadworks, traffic changes, events, or non-compliance.

  • Council will conduct regular inspections to ensure safety, accessibility, and presentation standards are met.

If the parklet is damaged through neglect or carelessness, businesses will be liable for repair costs.
